Terms of Service

These Terms are an agreement between you and SwoonTech Inc. (“we”, “us”), who run Swoonfic. They apply to the Swoonfic website and the Swoonfic apps (together, “Swoonfic”). By creating an account or using Swoonfic you accept these Terms and our Privacy Policy.

1. Who can use Swoonfic

Swoonfic is for adults. You must be 18 or older and able to enter a contract where you live. Swoonfic, including its AI characters, is not suitable for minors. We ask you to confirm your age before you start chatting. If we learn that someone under 18 is using Swoonfic, we close the account.

2. What Swoonfic is

Swoonfic lets you chat with characters from interactive romance stories.

  • The characters are AI. Their replies are written by AI models in real time, and so are the short narration lines that appear between messages. The characters are fictional: any resemblance to real people is a coincidence. Each chat marks the character as AI, and in a long conversation Swoonfic reminds you of this at least every three hours.
  • Pictures may be AI-made. Cover images, portraits and scene pictures of stories and characters may be created with AI tools and are reviewed by our team before they are shown.
  • Stories are romance, never explicit. We design and moderate them to stay that way.
  • AI can be wrong. Characters may say things that are untrue, inconsistent or unexpected. Nothing a character says is advice of any kind: medical, legal, financial or otherwise.

3. Your account

You can start chatting without an account; we keep your progress on a guest profile. You can sign in with Apple, Google or a code we send to your email. One account works on the website and in the apps, and your chats follow you.

Keep access to your sign-in method safe. You are responsible for what happens in your account. Tell us at [email protected] if you think someone else is using it.

You can delete your account at any time in Me → Delete account. We then delete your account and your chats as described in the Privacy Policy.

4. Free use and limits

Chatting is free up to a daily number of messages. The number you have left is shown in Swoonfic, and it can differ for guests, signed-in readers and Swoonfic+ members. When you reach it you can wait for the limit to reset or, if you are signed in, use sparks (see below). Swoonfic+ has a much higher limit meant for normal use, and after very heavy use we may answer with a lighter AI model.

We may change the limits, and we may slow down or pause use that looks automated or abusive, to keep Swoonfic fair and running.

5. Purchases

The website sells nothing. In the Swoonfic apps you can buy a Swoonfic+ subscription and sparks, only through the Apple App Store or Google Play.

  • Swoonfic+ renews automatically at the end of each period until you cancel. A free trial, if offered, turns into a paid subscription unless you cancel before it ends. Cancel in your App Store or Google Play account settings at least 24 hours before the renewal date.
  • Sparks let you send messages beyond the free daily limit and use some extra features, such as seeing what a character is thinking. Sparks are a licence to use features of Swoonfic: they have no cash value and cannot be sold, transferred or exchanged for money. [TO FILL: sparks expiry rule]
  • The store that took your payment handles billing, receipts and refunds under its own terms. If a store refunds or reverses a purchase, we take back the sparks or the Swoonfic+ time it gave you, as far as they are still unused.
  • What you bought belongs to your account: it also works on the website when you sign in with the same account.

Prices, features and limits may change. A change to a subscription price applies from the next period, after the notice the store requires.

6. Your messages

What you write stays yours. To run Swoonfic you give us a worldwide, non-exclusive licence to store, process and transmit your messages, including to our AI providers, so that characters can reply and the story can continue, and to moderate them. This licence ends when you delete your messages or your account, except where we must keep data by law.

Don’t share sensitive personal information about yourself or others in chats. Characters don’t need it.

7. What you may not do

You may not use Swoonfic to:

  • create, request or share sexual content involving minors, or content that sexualises anyone who appears to be a minor;
  • push characters toward explicit sexual content, or try to get around our safety systems;
  • harass, threaten or harm others, or encourage self-harm;
  • break the law or infringe anyone’s rights;
  • copy, scrape or automatically access Swoonfic, or reverse engineer it, except where the law allows;
  • resell or share your account, or get around limits, purchases or bans.

8. Safety and moderation

We check messages and replies with automated tools. A reply that breaks our rules may be replaced by a short notice, and if a message suggests you may harm yourself, the character steps out of the story and shows you where to get help. You can report any reply from its menu, and our team reviews reports. See Safety.

We may refuse or change a reply, remove content, limit features, or suspend or close an account that breaks these Terms. If we close your account for a serious breach, you may lose access to unused sparks, as far as the law allows.

9. Our content

Swoonfic, its stories, characters, pictures and software belong to us or our licensors. You may use them only to enjoy Swoonfic for yourself, not commercially.

10. Availability and changes

We work to keep Swoonfic available but cannot promise it will always be uninterrupted or error-free. We may add, change or remove features and stories. If we make an important change to these Terms, we will tell you in Swoonfic or by email before it applies; if you keep using Swoonfic after that, the new Terms apply.

11. Liability

Swoonfic is provided “as is” as far as the law allows. To the extent permitted by law, we are not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer where you live.

12. Ending

You can stop using Swoonfic and delete your account at any time. We may end these Terms or close Swoonfic with reasonable notice, or immediately for a serious breach.

13. Law and disputes

These Terms are governed by [TO FILL: governing law and courts]. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring a claim in its courts.
